CASCADE CHARTER TOWNSHIP
KENT COUNTY, MICHIGAN
A RESOLUTION TO SET A PUBLIC HEARING FOR THE
REVOCATION OF CERTAIN INDUSTRIAL DEVELOPMENT DISTRICTS IN THE TOWNSHIP
OF CASCADE
At a regular meeting of the Township Board of the Township of
Cascade, County of Kent, State of Michigan held in the Cascade
Historical Museum in said Township on the 12th day of March, 2003, at
7:00 p.m.
MEMBERS PRESENT: Carpenter, Goodyke, Jones, Julien, Kleinheksel,
Parrish and Timmons.
MEMBERS ABSENT: None
The following preamble and resolution was offered by Member
Carpenter and supported by Member Kleinheksel.
WHEREAS, Act 198 of the Public Acts of 1974, as amended provides
for local governmental units to establish Industrial Development
Districts in the respective townships and cities; and
WHEREAS, certain Industrial Development Districts have been
established in the Township of Cascade, Michigan by Resolution of the
Township Board;
and
WHEREAS, the Township Board now determines the existence of said
district is no longer in the best interest of the Township of Cascade;
and
WHEREAS, before revoking said districts, the Township Board shall
give written notice to the owners of all property within the several
districts, and shall afford the opportunity for a Hearing on the
revocation of the Industrial Development Districts; and
WHEREAS, before revoking said districts, the Township Board shall
also give notice to the public and taxpayers of the Township of
Cascade by publication of the notice of Hearing is substantially the
form attached hereto; and
WHEREAS, it is necessary to set a public hearing date for the
revocation of Industrial Development Districts;
NOW THEREFORE BE IT RESOLVED, that the Township Board for the
Township of Cascade, Michigan does hereby set the date of March
26, 2003 at 7:00 P.M. for a public hearing on whether to revoke the
Industrial
Developments Districts on the Township of Cascade listed on Exhibit
"A" attached hereto.
BE IT FURTHER RESOLVED that all resolutions or parts of resolutions
inconsistent herewith rescinded.

RESOLUTION REVOKING INDUSTRIAL DEVELOPMENT AND PLANT REHABILITATION
DISTRICTS CREATED BY THE TOWNSHIP PURSUANT TO ACT 198 OF THE PUBLIC
ACTS OF MICHIGAN OF 1972, AS AMENDED
At a regular meeting of the Township Board of the Township of
Cascade, County of Kent, State of Michigan held in the Cascade
Historical Museum in said Township on the 26th day of
March, 2003, at 7:00 p.m.
MEMBERS PRESENT: Carpenter, Jones, Julien, Kleinheksel,
Timmons, Parrish.
MEMBERS ABSENT: Goodyke
The following preamble and resolution was offered by Member Parrish
and supported by Member Kleinheksel.
WHEREAS, pursuant to Act 198 of the Public Acts of Michigan of
1974, as amended ("Act 198"), the Township has established an
Industrial Development and Plant Rehabilitation Districts identified
in the attached Exhibit "A" by resolution number, date of adoption and
name of applicant requesting the establishment (the "Act 198"
District"); and
WHEREAS, an industrial facilities exemption certificate has
been issued pursuant to Act 198 based on the recommendation of the
Township Board for certain Industrial Facilities within the Act 198
District; and
WHEREAS, the continued existence of the Act 198 Districts is no
longer required and The Township Board believes it to be in the best
interest of the Township to revoke the Act 198 Districts.
NOW THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
That the Act 198 Districts are hereby revoked and the resolutions
establishing such Act 198 Districts are hereby rescinded. That all
resolutions or parts of resolutions in conflict herewith shall be and
the same hereby rescinded to the extent of such conflict.

A RESOLUTION REQUESTING REVOCATION OF INDUSTRIAL
FACILITIES EXEMPTION CERTIFICATE NO. 93-493 ISSUED TO SYSTEM 2/90,
INC.
At a regular meeting of the Township Board of the Township of
Cascade, County of Kent, State of Michigan held in the Cascade
Historical Museum in said Township on the 26th day of
March, 2003, at 7:00 p.m.
MEMBERS PRESENT: Carpenter, Jones, Parrish, Timmons, Julien,
Kleinheksel.
MEMBERS ABSENT: Goodyke
The following preamble and resolution was offered by Member Parrish
and supported by Member Jones.
WHEREAS, Act No. 198 of the Public Acts of 1974, as amended,
provides for local governmental units to establish Industrial
Development Districts and approve Industrial Facilities Exemption
Certificates; and
WHEREAS, pursuant to the provisions if said Act, the Michigan
State Tax Commission issued Facilities Exemption Certificate No 93-493
on the 8th day of December, 1993: and
WHEREAS, said exempted facility is not being used by
System 2/90, Inc. due to the fact that they have moved to another
facility; and
WHEREAS, section 15 (2) of said Act, provides for the request
for revocation of exemption certificates "that the purposes for which
the certificate was issued are not being fulfilled as a result of a
failure of the holder to proceed in good faith with ………the operation
of the facility."; therefore,
BE IT RESOLVED, the Township Board of Cascade Charter Township,
Michigan hereby requests the Michigan State Tax Commission to revoke
the Industrial Facilities Exemption Certificate 93-493 issued to
System 2/90, Inc.

TOWNSHIP OF CASCADE
RESOLUTION OF TOWNSHIP BOARD ESTABLISHING INDUSTRIAL DEVELOPMENT
DISTRICT
At a regular meeting of the Township Board of the Township of
Cascade, County of Kent, State of Michigan, held in the Cascade
Historical Museum in said Township on the 16th day of
April, 2003, at 7:00 p.m.
MEMBERS PRESENT: Carpenter, Jones, Julien, Goodyke, Kleinheksel
and Timmons
MEMBERS ABSENT: Parrish
The following preamble and resolution was offered by Timmons and
supported by Goodyke.
WHEREAS, pursuant to Act No. 198 of the Public Acts of 1974, as
amended, Cascade Township has the authority to establish "Industrial
Development Districts" within the boundaries of the Township of
Cascade; and
WHEREAS, APV NA, Inc. has petitioned the Cascade Township Board
to establish an Industrial Development District in the area more
particularly described in Exhibit A attached hereto; and
WHEREAS, construction, acquisitions, alterations, or
installation of a proposed facility has not commenced at the time of
filing the request to establish this district; and
WHEREAS, written notice has been given by certified mail to all
owners of real property located within the district, and to the public
by newspaper advertisement in the Grand Rapids Press of the hearing on
the establishment of the proposed district; and
WHEREAS, on April 16, 2003, a public hearing was held at which
all of the owners of real property within the proposed Industrial
Development District and all residents and taxpayers of Cascade
Township were afforded and opportunity to be heard thereon; and
WHEREAS, the Cascade Township Board deems it to be in the
public interest of Cascade Township to establish the Industrial
Development District as proposed;
NOW THEREFORE, BE IT RESOLVED:
by the Cascade Township Board that the legally described parcel
of land, see Exhibit A attached, situated in the Cascade Township,
Kent County, Michigan, be and hereby is established as an Industrial
Development District pursuant to the provision of Act No. 198 of the
public act of 1974, as amended, to be known as APV NA, Inc.,
Industrial Development District.

RESOLUTION TO APPROVE APPLICATION FOR INDUSTRIAL
FACILITIES EXEMPTION CERTIFICATE
At a regular meeting of the Township Board of the Township of
Cascade, County of Kent, State of Michigan, held in the Cascade
Historical Museum, 2839 Thornapple River Drive, S.E., in said Township
on the 16th day of April, 2003, at 7:00 p.m.
MEMBERS PRESENT: Jones, Julien, Kleinheksel, Timmons, Carpenter
and Goodyke

The following preamble and resolution was offered by Timmons and
supported by Goodyke.
RESOLUTION TO APPROVE APPLICATION FOR INDUSTRIAL
FACILITIES EXEMPTION CERTIFICATE FOR APV NA, INC.
WHEREAS, pursuant to Act No. 198 of the Public Acts of 1974, as
amended ("Act 198"), and after a duly noticed public hearing held at
7:00 p.m. on April 16, 2003, this Board, by resolution, established
APV NA, Inc. Industrial District as requested by APV NA, Inc., and
WHEREAS, APV NA, Inc., has filed an Application for an
Industrial Facilities Exemption Certificate with respect to
installation of Personal Property within said Industrial Development
District; and
WHEREAS, before acting on said Application, a public hearing
was held before this Board on April 16, 2003, at the Township Museum,
2839 Thornapple River Drive, S.E., Grand Rapids, Michigan, at 7:00
p.m.; and
WHEREAS, written notification of said hearing was given to the
Township Assessor and to the legislative body of each taxing unit
which levies ad valorem property taxes within Cascade Township; and
WHEREAS, the Township Assessor and representatives of the
affected taxing units have been given an opportunity to be heard, and
the Township Board has considered any objections with regard to the
approval of an Industrial Facilities Exemption Certificate for APV NA,
Inc..
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
That the Township Board finds as follows:
That the application relates to a "new facility" within the meaning
of Act 198 and which are situated within the APV NA, Inc. District.
That the commencement of the construction and acquisition of the
new facilities described in the application occurred not earlier than
six (6) months before the filing of the application.
That new facility described in the application is calculated to
have the reasonable likelihood to create employment, retain employment
or prevent a loss of employment in Cascade Township.
That the aggregate State Equalized Valuation ("SEV") of real and
personal property exempt from ad valorem taxes within Cascade
Township, after granting this Certificate, will exceed five percent
(5%) of an amount equal to the sum of the SEV of Cascade Township,
plus the SEV of personal and real property thus exempted.
That the granting of the Industrial Facilities Exemption
Certificate for APV NA, Inc., considering together with the aggregate
amount of certificates previously granted and currently in force under
Act 198, and Act 255 of the Public Acts of 1978, shall not have the
effect of substantially impeding the operation of Cascade Township or
impairing the financial soundness of any taxing unit which levies ad
valorem property taxes in Cascade Township.
That the Application of APV NA, Inc., for an Industrial Facilities
Exemption Certificate be and is hereby approved.
That the Industrial Facilities Exemption Certificate, when issued,
shall be and remain in force and effect for a period of six (6)years.
That all resolutions and parts of resolutions insofar as they
conflict with the provisions of this resolution be and the same are
hereby rescinded.

WHEREAS, pursuant to Act No. 198 of the Public Acts of 1974, as amended
("Act 198"), and after a duly noticed public hearing held at 7:00 p.m.
on May 28, 2003, this Board, by resolution, established Performance Systematix,
Inc., Industrial District as requested by Performance Systematix,Inc., and
WHEREAS, Performance Systematix,Inc., has filed an Application for an
Industrial Facilities Exemption Certificate with respect to installation of
Personal Property within said Industrial Development District; and
WHEREAS, before acting on said Application, a public hearing was held before
this Board on May 28, 2003, at the Township Museum, 2839 Thornapple River Drive,
S.E., Grand Rapids, Michigan, at 7:00 p.m.; and
WHEREAS, written notification of said hearing was given to the Township
Assessor and to the legislative body of each taxing unit which levies ad valorem
property taxes within Cascade Township; and
